Text
Any landowner, or his legal representative, entitled to damages by reason of the closing of any private crossing may file a petition with the department of transportation for the assessment of the same within 30 days from the date of such order, and not otherwise. The department of transportation shall set a date and place of hearing, shall give notice to the parties that may be affected, and shall hear and determine the issues raised. Damages, if any, shall be assessed against the railroad or the other interested parties in such proportion as said department of transportation shall order.
