Text
Any person who obstructs or in any way injures any ditch opened as provided in section
24-06-26 is liable to pay to the overseer of highways of such road district double the damages
caused by such injury, which must be assessed by the jury or court, and also is guilty of a class
B misdemeanor, and the civil damages, when collected by the overseer, must be deposited in
the road fund established by section 24-06-17, and must be expended in accordance with
section 24-06-19.
