If either party refuses to submit to arbitration as provided in this chapter, that party must be
deemed to have waived all claims and demands, and the arbitrators shall proceed to determine
the controversies set forth by the moving party according to the justice of the case. Judgment
must be entered upon the award of such arbitrators in all things the same as though the
submission to arbitration has been signed by both parties.
