§ 104E-16 — Nonreverting Radiation Protection Fund

(a)There is hereby established under the control and direction of the Department a Nonreverting Radiation Protection Fund which shall be used to defray the expenses of any project or activity for:
(1)Emergency response to and decontamination of radiation accidents as provided in G.S. 104E-9(a)(5), or
(2)Perpetual maintenance and custody of radioactive materials as the Department may undertake. In addition to any moneys that shall be appropriated or otherwise made available to it, the Fund may be maintained by fees, charges, or other moneys paid to or recovered by or on behalf of the Department under the provisions of this Chapter, except for the clear proceeds of penalties.
