53-7-205 . Eligibility for services.

(1)A person may receive services provided for under this part if the department determines that:
(a)the person has a severe disability;
(b)the person lacks social competence, mobility, experience, skills, training, or other characteristics of independence;
(c)the person is in need of services provided for under this part; and
(d)the needed services are available for that person.
(2)The receipt of services under this part by an eligible person shall be governed by an individual service plan developed in accordance with state and federal requirements.
