Text

41-3-106 . Prosecution of offenders.

(1)If the evidence indicates violation of the criminal code, it is the responsibility of the county attorney to file appropriate charges against the alleged offender.
(2)The filing of a criminal charge does not toll a proceeding under this chapter.
(3)The district court has original jurisdiction under this section.
