50-20-1003 . Dismemberment abortion procedures prohibited -- penalty.

(1)Except in a medical emergency, a person may not purposely or knowingly perform, induce, or attempt to perform or induce a dismemberment abortion procedure.
(2)A person who violates this section is guilty of a felony and on conviction shall be punished by a fine in an amount not to exceed $50,000, imprisonment for a term of not less than 5 years and not more than 10 years, or both.
(3)A woman on whom an abortion is performed, induced, or attempted in violation of this part may not be prosecuted for conspiracy to commit a violation of this part.
