75-2-108 . Small business stationary sources -- exceptions -- waivers.

(1)Upon petition, the department may designate a source to be a small business stationary source for purposes of receiving assistance from the small business stationary source technical and environmental compliance assistance program if the stationary source does not emit more than 100 tons per year of all air pollutants and:
(a)is a major stationary source as defined in Subchapter V of the federal Clean Air Act, 42 U.S.C. 7661, et seq.;
(b)emits 50 tons or more per year of an air pollutant; or
(c)emits more than 75 tons per year of all air pollutants.
(2)After notice and an opportunity for public comment, the department may grant a petition submitted under subsection (1) upon finding that the source of air polluta
