76-13-422 . Purpose of onsite consultation -- department responsibility.

(1)The onsite consultation provided for in 76-13-421 is intended only for the purpose of providing information to owners and operators and does not confer upon the department or any other agency of state or local government authority to compel an owner or operator to undertake or refrain from undertaking specific management practices that are not otherwise regulated by law or rule.
(2)The department does not incur any obligation or liability by virtue of a decision to conduct or not conduct an onsite consultation.
(3)To the extent practicable, the department shall evaluate the application of forest practices as part of an onsite inspection, relating to the control of timber slash and debris, conducted under the pro
