§ 7-13-4204 — Rental Charges For Use Of Sewer System -- Election Required

7-13-4204 . Rental charges for use of sewer system -- election required.

(1)Upon being petitioned by 5% of the registered electors who are residents of the city or town, the city or town council shall conduct an election in accordance with Title 13, chapter 1, part 5, on the question of whether or not the city or town council may establish and collect rentals for the use of the sewer system, may fix the scale of the rentals, and may prescribe the manner and time at which the rentals must be paid:

(a)to provide the sewer fund;

(b)to provide for the retirement of the bonds and the payment of the interest on the bonds; or

(c)for any purpose mentioned in this section.

(3) The revenue provided in this section is in addition to and not exclusive of other revenue that may be legally collected for sewer payment.
