No person shall operate, maintain, conduct, advertise, or sell or furnish tickets for a festival in any county in this state unless he first obtains a license from that county to operate, maintain or conduct the festival. This provision shall not apply to counties of the first class having a charter form of government and having a population of nine hundred thousand inhabitants or more and no city not within a county which exercises county functions.
