Every individual, partnership, or private corporation to whom any planting stock is supplied for planting on private land under sections89.35to89.39must execute an agreement, in a format approved by the commissioner, to comply with the requirements of sections89.35to89.39and conditions prescribed by the commissioner thereunder. Any party to such an agreement who violates the agreement is, in addition to any other penalties that may be applicable, liable to the state in a sum equal to three times the reasonable value of the trees affected by the violation at the time the trees were shipped for planting; provided, that if the trees are sold or offered for sale for any purpose not authorized under sections89.35to89.39, the penalty is equal to three times the sale price.
