Subdivision 1.Upper payment limit.

(a)In the event the board finds that the spending on a prescription drug product reviewed under section62J.91creates an affordability challenge for the state health care system or for patients, the board shall establish an upper payment limit after considering:
(1)extraordinary supply costs, if applicable;
(2)the range of prices at which the drug is sold in the United States according to one or more pricing files accessed under section62J.90, subdivision 1, and the range at which pharmacies are reimbursed in Canada; and
(3)any other relevant pricing and administrative cost information for the drug.
(b)An upper payment limit applies to all purchases of, and payer reimbursements for, a prescription drug that is dispensed or administered to individuals
