Subdivision 1.Provider requirements. A provider of individual community living supports must not be the landlord of the participant receiving individual community living supports, nor have any interest in the participant's housing. Subd. 2.Licensing standards. Licensing standards for individual community living supports shall be reviewed jointly by the Departments of Health and Human Services to avoid conflict with provider regulatory standards pursuant to sections144A.43to144A.483and chapter 245D. Subd. 3.Setting requirements. Individual community living supports must be delivered in a single-family home or apartment that the participant or the participant's family owns or rents, as demonstrated by a lease agreement, and maintains control over the individual unit.
