(a)Direct Care and Treatment shall contract with the Department of Human Services to provide determinations on issues of county of financial responsibility under chapter 256G and to provide administrative and judicial review of direct care and treatment matters according to section256.045.

(b)The executive board may prescribe rules necessary to carry out this section, except that the executive board must not create any rule purporting to control the decision making or processes of state human services judges under section256.045, subdivision 4, or the decision making or processes of the commissioner of human services issuing an advisory opinion or recommended order to the executive board under section256G.09, subdivision 3. (c) The executive board and commissioner of human services may adopt joint rules necessary to accomplish the purposes of this section.
