Section 8.

(a)(1) No person shall operate any vessel on the waters of the commonwealth with a percentage, by weight, of alcohol in their blood of eight one-hundredths or greater, or while such person is under the influence of intoxicating liquor or marijuana, narcotic drugs, depressant or stimulant substances, as defined in chapter ninety-four C, or from smelling or inhaling the fumes of any substance having the property of releasing toxic vapors as defined in section 18 of chapter 270.
(A)Whoever so operates any vessel shall be punished by a fine of not less than one hundred nor more than one thousand dollars, or by imprisonment for not more than two and one-half years, or both.If the defendant has been previously convicted or assigned to an alcohol education or rehabilitation program by
