Section 2. As used in this chapter the following words shall, unless the context clearly requires otherwise, have the following meanings:—''Activity and use limitation'', a restriction, covenant or notice concerning the use of real property which is imposed upon real property by a property owner or the department pursuant to and in accordance with this chapter and regulations promulgated hereunder.''Assess'' and ''Assessment'', such investigations, monitoring, surveys, testing, and other information gathering activities to identify:

(1)the existence, source, nature and extent of a release or threat of release of oil or hazardous materials;
