§ 8DDD — Coverage for identified generic and brand name drug used to treat diabetes, asthma, and certain heart conditions

[ Text of section added by 2024, 342, Sec. 33 effective April 8, 2025 applicable to all contracts entered into, renewed or amended on or after July 1, 2025. See 2024, 342, Sec. 39.]Section 8DDD.

(a)As used in this section, the following words shall have the following meanings unless the context clearly requires otherwise:"Brand name drug'', a drug that is:
(i)produced or distributed pursuant to an original new drug application approved under 21 U.S.C. 355(c) except for:
(A)any drug approved through an application submitted under section 505(b)(2) of the Federal Food, Drug, and Cosmetic Act that is pharmaceutically equivalent, as that term is defined by the United States Food and Drug Administration, to a drug approved under 21 U.S.C. 355(c);
(B)an abbreviated new drug application t
