Section 1. As used in this chapter, the following words shall, unless the context requires otherwise, have the following meanings:—''Applicant'', a person filing an application for registration of a mark under this chapter, and the legal representatives, successors, or assigns of that person.''Mark'', a trademark or service mark, entitled to registration under this chapter whether registered or not.A mark shall be considered ''abandoned'' when either of the following occurs:—

(a)When its use has been discontinued with intent not to resume the use. Intent not to resume may be inferred from circumstances. Nonuse for 2 consecutive years shall constitute prima facie evidence of abandonment.
(b)When any course of conduct of the owner, including acts of omission as well as commission, causes th
