Section 35MMM. There shall be a Childhood Lead Poisoning Prevention Trust Fund. The fund shall be administered by the commissioner of public health for the operation of the childhood lead poisoning prevention program, which shall include, but not be limited to, providing for the: (i) production and dissemination of educational and other materials pertaining to lead paint poisoning prevention and treatment as required by sections 192B and 197A of chapter 111; (ii) training of lead paint inspectors; and (iii) training of homeowners in those aspects of lead paint abatement or containment that the department of public health, through regulations, authorizes homeowners to perform themselves.The fund shall be credited with: (i) all revenue collected from the surcharge imposed by section 22 of chapter 482 of the acts of 1993; (ii) appropriations or other money authorized by the general court and specifically designated to be credited to the fund; and (iii) funds from public or private sources, including, but not limited to, gifts, grants, donations and settlements received by the commonwealth that are specifically designated to be credited to the fund.Amounts credited to the fund shall not be subject to further appropriation and money remaining in the fund at the close of a fiscal year shall not revert to the General Fund and shall be available for expenditure in subsequent fiscal years.Not later than October 1, the commissioner shall provide an annual report to the joint committee on public health and the senate and house committees on ways and means providing a description and accounting of the revenue credited to the fund and expenditures made from the fund.
