§931. Creation; personnel
An agency of the state to be known as the office of elderly affairs is hereby created and established in the office of the governor. Said office shall exercise the powers and duties hereinafter set forth or otherwise provided by law. The Department of Elderly Affairs is hereby created. The department shall exercise the powers and duties set forth in this Chapter or otherwise provided by law. The department shall be administered by a secretary, who shall be appointed by the governor, subject to Senate confirmation, from recommendations for appointment by the Louisiana Executive Board on Aging. The secretary shall serve at the pleasure of the governor. The secretary shall employ necessary staff to carry out the duties and functions of the department as otherwise provided in this Chapter, or as otherwise provided by law.

July 1, 2013, provides that funds allocated for any purpose under the authority of the Office of Elderly Affairs or its successor, the Dept. of Elderly Affairs, are allocated only to the Office of Elderly Affairs or its successor and are not to be appropriated, allocated, or transferred to any other state department, office, or programs.
