§438.6. Recovery A. Actual damages.
(1)Actual damages incurred as a result of a violation of the
provisions of this Part shall be recovered only once by the medical assistance programs and
shall not be waived by the court.
(2), (3) Repealed by Acts 2025, No. 206, §2.
B. Civil fine.
(1)Any person who is found to have violated R.S. 46:438.2 shall be
subject to a civil fine in an amount not to exceed ten thousand dollars per violation, or an
amount equal to three times the value of the illegal remuneration, whichever is greater.
(2)Except as limited by this Section, any person who is found to have violated R.S.
46:438.3 shall be subject to a civil fine in an amount not to exceed three times the amount
of actual damages sustained by the medical assistance programs as a result of the violati
