(l)When the award of a contract for the purchase of goods or
services has been set aside for enterprise participation, the award shall be made
to an enterprise on the basis of competitive bidding under the Louisiana
Procurement Code, R.S. 39:1551 et seq.
(2)For contracts designated for minority business enterprise
participation, when the division confirms that there are less than three
minority-owned businesses or less than three minority-owned businesses that
may be certified in the state of Louisiana as minority business enterprises for
any procurement under this Chapter, the award shall be made
