§85. Powers of the secretary A. The powers of the assistant secretary shall include without limitation the power to do the following, subject to the supervision of the secretary:

(1)Adopt and promulgate rules and regulations implementing the administration of this Part.
(2)Perform such specific functions as may be enumerated by the provisions of this Part.
(3)The secretary shall perform all regulatory functions imposed by this Part.
(4)Modify funding requirements of site-specific trust accounts either upon recommendation of the trust authority, the secretary, or upon his own determination, based upon changes in operation, site conditions, or trust account status.
