§1346.6. Enforcement and regulation; penalties; severability
A.The department shall enforce the provisions of this Subpart and may adopt,
amend, and repeal administrative rules in accordance with the Administrative Procedure Act
for the implementation and enforcement of this Subpart.
B.Insurers found in violation of this Subpart are subject to penalties as prescribed
in this Title, including but not limited to fines, suspension, or revocation of a license to
operate within the state.
C.If any provision of this Subpart or its application to any person or circumstance
is held to be invalid, the invalidity does not affect the remainder of this Subpart that can be
given effect without the invalid provision or application.
