§2272. Excess benefit plan A. There is hereby established a separate unfunded, nonqualified excess benefit plan pursuant to Section 415(m) of the Internal Revenue Code, as amended. B.
(1)The purpose of this excess benefit plan is to enable employers to pay to
members benefits which would exceed the limitations of Section 415(b) but for the
existence of the excess benefit plan.
(2)The excess benefit plan shall be operated as a trust, separate and apart from
the retirement system, the trustees of which shall be the trustees of the retirement
system.
(3)The funds of the excess benefit plan shall not be a part of the funds of the
retirement system nor shall they be commingled therewith. The retirement system
may not transfer funds to the excess benefit plan.
