§1004. False statements or falsification of records; penalty; liability; correction of errors
A. Any person who knowingly makes any false statement or falsifies or permits to
be falsified any record or records affecting this retirement system in any attempt to defraud
the same shall be fined not to exceed three hundred dollars or imprisoned for not more than
six months or both. Should any change or error in the records result in any member or
beneficiary receiving from the retirement system more or less than he would have been
entitled to receive had the records been correct, the board of trustees shall make the necessary
corrections and adjustments in payment.
B. Knowingly including school bus operators who did not personally drive the school
bus for the time indicated on the checklist sent to the retirement system at the end of the
fiscal year shall subject the employee so indicated on the checklist, the supervisor of
transportation, the parish or city superintendent, the school official signing the checklist, and
the school board to the penalties provided in Subsection A of this Section.
C. In the event payments made to a retired member or to his beneficiary are greater
than the member's contribution to the system and the member did not actually drive the
school bus as indicated on the checklist, then the retired member, his beneficiary, the
supervisor of transportation, the parish or city superintendent, the school official signing the
checklist, and the school board who have knowingly falsified the reports mentioned in
Subsections A and B shall be liable for the excess amounts paid to the retired member or to
his beneficiary. The provisions of this Section shall be enforced by the attorney general and
the district attorney having proper jurisdiction upon the written request therefor of the board
of trustees. In the event action to enforce the provisions of this Section is not taken within
a reasonable period of time after the request of the board of trustees, then the district attorney
having jurisdiction in the parish where the board of trustees is domiciled shall enforce the
provisions of this Section upon the written request of the board of trustees.
