(a)The commission may issue a three-way
permit to a hotel situated outside the corporate limits of an incorporated
city or town if the establishment meets the following requirements:
(1)It shall be provided with special space and accommodations
where, in consideration of payment, food and lodging are
habitually furnished to travelers.
(2)It shall have at least twenty-five (25) adequately furnished and
completely separate sleeping rooms with adequate facilities under
one (1) roof.
(3)It shall be so disposed that persons usually apply for and
receive overnight accommodations in it in the course of usual and
regular travel or as a residence.
(4)It shall operate either a:
(A)regular dining room constantly frequented by customers
each day; or
(B)room in which continental breakfasts and h
