§ 32-35-2-34 — Judgment for defendant; contents

Indiana·Title 32 PROPERTY·Art. 35 CAUSES OF ACTION CONCERNING PERSONAL·Ch. 2 Replevin

In an action to recover the possession of personal property, if the property has been delivered to the plaintiff and the defendant claims a return of the property, judgment for the defendant may be for:

(1)the return of the property, or its value, in case return is not possible; and
(2)damages for the taking and withholding of the property. [Pre-2002 Recodification Citation: 34-21-9-2.]
