§ 32-28-8-1 — Limitation of actions

Indiana·Title 32 PROPERTY·Art. 28 LIENS ON REAL PROPERTY·Ch. 8 Foreclosure and Expiration of Liens on Public
(a)Except as provided in subsection (b), an action may not be brought for the foreclosure of a lien of an assessment for a:
(1)street;
(2)sewer;
(3)sidewalk;
(4)ditch; or
(5)other public improvement; if the action is not commenced within five (5) years after the right of action accrues.
(b)If an assessment described in subsection (a) is payable in installments, an action may be brought within fifteen (15) years after the date of the final approval of the assessment as shown by the record creating the lien. [Pre-2002 Recodification Citation: 32-8-8-1.]
