Text

For purposes of this chapter, the following are not adverse possessions or prescriptive easements to the owner and do not establish title or rights to the real property:

(1)Possession of a right-of-way by a nonrailroad purchaser under section 8 of this chapter.
(2)Possession of a right-of-way by a public utility or under a communication, cable television, fiber optic, or pipeline easement, license, or legal occupancy under section 11 of this chapter.
(3)Possession of a right-of-way by a responsible party (as defined in IC 8-4.5-1-17). [Pre-2002 Recodification Citation: 32-5-12-14.]
