Text
(a)A person who shall for himself or herself,
or on behalf of any other person, procure the filing or registration of
any mark in the office of the secretary under this chapter by knowingly
making a false or fraudulent representation or declaration orally, in
writing, or by other fraudulent means, is liable for all damages
sustained in consequence of the filing or registration.
(b)The damages may be recovered by or on behalf of the injured
party in a court of competent jurisdiction.
