Text

(a)"Demand letter" means a letter, electronic mail, or any other written, including electronic, communication asserting that a target has engaged in patent infringement.
(b)The term does not include a complaint alleging patent infringement, or other documents related to an action for patent infringement, filed:
(1)in a United States District Court; or
(2)with the International Trade Commission.
