5.

(a)As used in this chapter, "adult education and literacy activities" means instructional programs, learning activities, and services provided to an individual who is:
(1)at least sixteen (16) years of age;
(2)not:
(A)enrolled; or
(B)required by state law to be enrolled; in high school; and
(3)deficient in basic skills.
(b)Subsection (a)(3) includes an individual who:
(1)does not have a:
(A)high school diploma; or
(B)high school equivalency diploma;
(2)has not attained a level of education equivalent to a level of education described in subdivision (1); or
(3)is an English language learner.
(c)For purposes of subsection (a), "instructional programs, learning activities, and services" includes one (1) or more of the following:
(1)Adult education.
(2)Literacy.
(3)Workplace
