5.

(a)This section applies to a calendar year that begins after December 31, 2010, to an employer:
(1)that is subject to this article for wages paid during the calendar year;
(2)whose contribution rate for the calendar year was determined under this chapter, IC 22-4-11, IC 22-4-11.5, or IC 22-4-37-3; and
(3)that:
(A)has been subject to this article during the preceding thirty-six (36) consecutive calendar months; and
(B)has had a payroll in each of the three (3) preceding twelve
(12)month periods; if, during the calendar year, the state is required to pay interest on the advances made to the state from the federal unemployment account in the federal unemployment trust fund under 42 U.S.C. 1321.
