Text
(a)This section applies only to a utility scale
battery energy storage system installation of which is subject to
department approval under section 4(a)(1) of this chapter.
(b)If a utility scale battery energy storage system is located less
than one-half (1/2) mile from the nearest one hundred (100) year flood
plain, as determined by the most recently issued Federal Emergency
Management Agency (FEMA) Flood Insurance Rate Maps, all of the
system's equipment must be located at least two (2) feet above the one
hundred (100) year frequency flood elevation.
