§ 16-52-2-1 — Registry; application; required information; fee; waiver

(a) The state department shall establish a
temporary health care services agency registry.
(b) The state department shall develop an application for the registry
that at least requires the applicant to provide the following:
(1) The name and addresses of each person that has an ownership
interest in the temporary health care services agency.
(2) If the owner is a corporation or other business entity:
(A) the name of the state in which the business is incorporated,
a copy of the articles of incorporation or association or similar
documentation, and any amendments or bylaws;
(B) the location of its principal place of business; and
(C) the names and addresses of its directors and officers.
(3) A schedule or description of all fees, charges, or commissions
that the temporary health care services agency expects to charge
and collect for services.
(c) Except as provided in subsection (e), the state department shall
establish and collect an annual registration fee of at least one hundred
fifty dollars ($150) for the registry. Fees collected under this chapter
shall be paid to the state general fund.
(d) If a temporary health care services agency changes the agency's
schedule or description of fees, charges, or commissions that were
submitted under subsection (b)(3), the temporary health care services
agency shall file the changes with the state department at least thirty
(30) days before the changes are set to be effective.
(e) The state department may waive the registration fee under
subsection (c) for a charitable and benevolent organization or
association, as determined by the state department and in consultation
with the division of family resources.
