§ 16-42-1-32 — Notice and opportunity for hearing preceding criminal prosecution

Before any violation of IC 16-42-1 through
IC 16-42-4 is reported by the state health commissioner or the
commissioner's authorized agent to a prosecuting attorney for the
institution of a criminal proceeding, the person against whom the
proceeding is contemplated shall be given appropriate notice and an
opportunity to present the person's views to the state health
commissioner or the commissioner's authorized agent, either orally or
in writing, with regard to the contemplated proceeding.
