§ 16-41-20-3 — Exercise of powers by the state health department

The state department may not exercise a
power granted in this chapter without giving to the local board of
health or county health officer having jurisdiction a notice setting forth
the conditions that have been certified to the state department or of
which the state department has knowledge. If the local board of health
or county health officer fails to act not more than three (3) days after
the notice, the state department may exercise the granted powers.
