§ 16-27.5-2-4 — Commission duties

Effective 9-1-2025.
Sec. 4. (a) The commission shall do the following:
(1) Consider and make determinations concerning the
qualifications of individuals who apply for any of the following:
(A) A certification as a nurse aide.
(B) A certification as a qualified medication aide.
(C) A registration as a home health aide.
(2) Renew registrations and certifications under this article.
(3) Consider and make determinations concerning the
qualifications for the following training programs:
(A) Nurse aide.
(B) Qualified medication aide.
(C) Home health aide.
(4) Consider and make determinations concerning the
qualifications for instructors of nurse aide training programs and
qualified medication aide training programs.
(5) Consider and make determinations concerning the curriculum
for the following programs:
(A) A nurse aide training program.
(B) A qualified medication aide training and competency
evaluation program.
(C) A home health aide training and competency evaluation
program.
(6) Direct the state department:
(A) regarding the implementation of this subsection; and
(B) to adopt rules under IC 4-22-2 to implement this article.
(b) The commission shall:
(1) review evidence concerning allegations against a certified
nurse aide, qualified medication aide, or home health aide
submitted by the state department under IC 16-27.5-1;
(2) allow an individual described in subdivision (1) to provide an
oral or written statement to the commission concerning the
evidence; and
(3) if appropriate, direct the state department to enter a finding in
the registry established under IC 16-27.5-1 against the individual
described in subdivision (1).
