5.

(a)If a home health agency or a personal services agency has knowledge of a conviction of an employee of the home health agency or personal services agency that would indicate unfitness for service as a home health aide, other unlicensed employee, or other health care professional, the home health agency or personal services agency shall report the information to the state nurse aide registry or the appropriate licensing authority.
(b)The state department shall:
(1)investigate any report that a home health aide has been convicted of a crime described in section 5(a) of this chapter; and
(2)remove the home health aide from the state nurse aide registry with an appropriate notation indicating the reason the home health aide was removed from the registry, providing notice and appeal ri
