§ 15-16-5-55 — Exemptions from licenses
Section 48 of this chapter relating to pesticide business licenses and requirements for their issuance does not apply to the following:
(1)A farmer who applies pesticides for the farmer's own use or
with ground equipment or manually for the farmer's neighbors if:
(A)the farmer operates farm property and operates and
maintains pesticide application equipment primarily for the
farmer's own use;
(B)the farmer is not engaged in the business of applying
pesticides for hire and the farmer does not publicly profess to
be a pesticide business;
(C)the farmer operates the farmer's pesticide application
equipment only in the vicinity of the farmer's own property and
for the accommodation of the farmer's neighbors without any
compensation; and
(D)the farmer is certified as a private applicator if
