If the participating entities determine that the
regional jail agreement entered into under this chapter shall be
administered by a separate legal entity as authorized by IC 36-1-7-3(a)(5)(A) or by a joint board as authorized by IC 36-1-7-3(a)(5)(B), the county sheriff of each county participating in the
agreement (or the county sheriff's designee) must be included as a
member on the governing board of the separate legal entity or as a
member of the joint board.
