§ 209
Illinois·Topic RIGHTS AND REMEDIES·Ch. 720 CRIMINAL OFFENSES·Act 720 ILCS 570/ Illinois Controlled Substances Act.·Art. Article II -
The Department, taking into consideration the recommendations of its Prescription Monitoring Program Advisory Committee, may issue a rule scheduling a substance in Schedule IV if it finds that:
(1)the substance has a low potential for misuse relative to substances in Schedule III;
(2)the substance has currently accepted medical use in treatment in the United States; and (3) misuse of the substance may lead to limited physiological dependence or psychological dependence relative to the substances in Schedule III.
