§ 7-1-42 — Redistricting after annexation

(a) If the increase in population resulting from the annexation of any territory to a city under the alderperson form of government is sufficient to entitle that city to an increase in the number of alderpersons as provided in Section 3.1-20-10, the corporate authorities shall redistrict the city in accordance with Sections 3.1-20-15 and 3.1-20-25. Section 3.1-20-10 shall govern as to the hold-over alderpersons. (b) If the increase in population is not sufficient to entitle the city to an increase in the number of alderpersons, the corporate authorities shall make the annexed territory a part of the ward or wards that it adjoins. (c) If a village of over 25,000 population is divided into 6 districts as provided in Section 3.1-25-75, the corporate authorities shall make any territory annexed to the village a part of the districts that the territory adjoins. (d) Nothing contained in this Section 7-1-42 shall prevent the corporate authorities of any municipality from redistricting the municipality according to law. Whenever the enlarged annexing municipality is redistricted, the corporate authorities are under no duty to treat the annexed territory as a unit and they may divide it as if it had always been a part of the municipality. (e) The number of inhabitants determined by the last national, state, or school census in the annexed territory and in the annexing municipality controls in the application of this Section.
