Site characterization; license application; adjudicatory hearing; exclusivity.

(a)If the contractor chosen under Sections 5 and 10, following characterization, determines that the proposed site is appropriate for the development of a regional disposal facility, the contractor shall submit to the Agency an application for a license to construct and operate the facility at the selected site.
(b)If the contractor determines, following or at any time during characterization of a site, that the proposed site is not appropriate for the development of a regional disposal facility, the Agency may require the contractor to propose an additional site from the locations identified under the site selection process established under subsection (c-5) of Section 10.2.
