(a)The Professional Services Fund is created as a revolving fund in the State treasury. The following moneys shall be transferred or deposited into the Fund:
(1)amounts authorized for transfer to the Fund from the General Revenue Fund and other State funds (except for funds classified by the Comptroller as federal trust funds or State trust funds) pursuant to State law or Executive Order;
(2)federal funds received by the Department of Central Management Services (the "Department") as a result of expenditures from the Fund;
(3)interest earned on moneys in the Fund; and (4) receipts or inter-fund transfers resulting from billings issued by the Department to State agencies for the cost of professional services that are rendered by the Department, the Executive Ethics Commission, the Chief

(a) The Professional Services Fund is created as a revolving fund in the State treasury. The following moneys shall be transferred or deposited into the Fund: (1) amounts authorized for transfer to the Fund from the General Revenue Fund and other State funds (except for funds classified by the Comptroller as federal trust funds or State trust funds) pursuant to State law or Executive Order; (2) federal funds received by the Department of Central Management Services (the "Department") as a result of expenditures from the Fund; (3) interest earned on moneys in the Fund; and (4) receipts or inter-fund transfers resulting from billings issued by the Department to State agencies for the cost of professional services that are rendered by the Department, the Executive Ethics Commission, the Chief Procurement Officer appointed under paragraph (4) of subsection (a) of Section 10-20 of the Illinois Procurement Code, or the Commission on Equity and Inclusion and that are not compensated through the specific fund transfers authorized by this Section. (b) Moneys in the Fund may be used by the Department for reimbursement or payment for: (1) providing professional services to State agencies or other State entities; (2) rendering other services to State agencies at the Governor's direction or to other State entities upon agreement between the Director of Central Management Services and the appropriate official or governing body of the other State entity; or (3) providing for payment of administrative and other expenses incurred by the Department in providing professional services. Beginning in fiscal year 2021, moneys in the Fund may also be appropriated to and used by the Executive Ethics Commission for oversight and administration of the eProcurement system known as BidBuy, and by the Chief Procurement Officer appointed under paragraph (4) of subsection (a) of Section 10-20 of the Illinois Procurement Code for the operation of the BidBuy system previously administered by the Department. Beginning in fiscal year 2022, moneys in the Fund may also be appropriated to and used by the Commission on Equity and Inclusion for its operating and administrative expenses related to the Business Enterprise Program, previously administered by the Department. (c) State agencies or other State entities may direct the Comptroller to process inter-fund transfers or make payment through the voucher and warrant process to the Professional Services Fund in satisfaction of billings issued under subsection (a) of this Section. (d) Reconciliation. For the fiscal year beginning on July 1, 2004 only, the Director of Central Management Services (the "Director") shall order that each State agency's payments and transfers made to the Fund be reconciled with actual Fund costs for professional services provided by the Department on no less than an annual basis.
