§ 22c

(Section scheduled to be repealed on January 1, 2028) Sec. 22c. Automated prescription refills. (a) Before a prescription that has a refill on file from a prescribing practitioner may be included in an auto-refill program, a patient or patient's agent must enroll each prescription medication in an auto-refill program. Prescriptions without a refill on file are not eligible for auto-refill. (b) Beginning January 1, 2021, a pharmacy using the National Council for Prescription Drug Programs's SCRIPT standard for receiving electronic prescriptions must enable, activate, and maintain the ability to receive transmissions of electronic prescription cancellation and to transmit cancellation response transactions. (c) Within 2 business days of receipt of a prescription cancellation transaction, pharmacy staff must either review the cancellation transaction for deactivation or provide that deactivation occurs automatically. (d) The Department shall adopt rules to implement this Section. The rules shall ensure that discontinued medications are not dispensed to a patient by a pharmacist or by any automatic refill dispensing systems, whether prescribed through electronic prescriptions or paper prescriptions.
