If judgment is rendered against the plaintiff upon the trial of said action, said judgment
shallincludethereasonableexpensesincurredbythedefendantandthedefendant’sattorney
in appearing to and defending against said action, provided that in the judgment of the trial
court said action was commenced maliciously or without probable cause.
