1. A waste tire management fund is created within the state treasury. Notwithstanding
section 8.33, any unexpended balance in the fund at the end of each fiscal year shall be
retained in the fund. Notwithstanding section 12C.7, any interest or earnings on investments
from moneys in the fund shall be credited to the fund. Moneys from the fund that are
expended by the department in closing or bringing into compliance a waste tire collection
site pursuant to section 455D.11A and later recouped by the department shall be credited
to the fund.
2. Moneys in the waste tire management fund are appropriated and shall be used for the
following purposes:
a. Thirty percent of the moneys shall be used for all of the following positions:

(1) One full-time equivalent position for the administration of permits and registrations
for tire processing, storage, and hauling activities, and tire program initiatives.
(2) One and one-half full-time equivalent positions for waste tire-related compliance
checks and inspections. The full-time equivalent positions shall be divided equally between
the field offices in the state.
b. Ten percent of the moneys shall be used for a public education and awareness initiative
related to the proper tire disposal options and environmental and health hazards posed by
improper tire storage.
c. Thirty percent of the moneys shall be used for market development initiatives for waste
tires.
d. Thirty percent of the moneys shall be used for waste tire stockpile abatement initiatives
which would require a cost-share agreement with the landowner.
